TERMS & CONDITIONS

Article 1 – Definitions

Article 3 – Applicability

These Terms & Conditions apply to all offers, orders, and distance contracts between GARAX and the consumer.

Before the agreement is concluded, these Terms & Conditions are made available to the consumer. If this is not reasonably possible, it will be stated that the Terms & Conditions can be viewed and will be sent free of charge upon request.

If the agreement is concluded electronically, the Terms & Conditions will be made available digitally in a way that allows the consumer to store them on a durable data carrier.

In case of conflicting provisions, the provision most favorable to the consumer shall prevail.

Article 4 – The Offer

All offers are non-binding and subject to availability.

Product descriptions and images are indicative. Minor deviations in color, detail, or finish may occur and do not constitute grounds for compensation or contract termination.

Prices exclude import duties, customs clearance fees, and import VAT where applicable. These costs are the responsibility of the customer.

Article 5 – The Agreement

The agreement is concluded when the consumer accepts the offer and completes the order process.

GARAX reserves the right to refuse or cancel an order if payment obligations cannot be met or in case of stock issues.

All agreements are subject to product availability.

Article 6 – Right of Withdrawal

Consumers have the right to withdraw from the agreement within 14 days of receiving the product, without stating a reason.

During the withdrawal period, the product must be handled with care and only used to assess suitability.

To exercise the right of withdrawal, the consumer must notify GARAX by email within 14 days and return the product within 14 days after notification.

Article 7 – Costs in Case of Withdrawal

Return shipping costs are borne by the customer.

Refunds will be processed within 14 days after receiving the returned product or proof of return.

If the return is due to an error or defect caused by GARAX, return costs will be reimbursed.

Article 8 – Exclusion of the Right of Withdrawal

The right of withdrawal does not apply to:

  • Customized or personalized products

  • Products damaged due to misuse

  • Products not returned in unused condition where required

Article 9 – Prices

Prices are displayed in EUR and/or USD and may change without prior notice.

Price increases due to tax or legal changes are permitted.

GARAX is not liable for typographical errors.

Article 10 – Conformity and Warranty

Products must comply with the agreement and reasonable quality expectations.

Defects or incorrect deliveries must be reported within 14 days after receipt.

Warranty does not apply if damage is caused by improper use or modifications.

Article 11 – Delivery and Execution

GARAX ships worldwide.

Orders are shipped from the EU and/or outside the EU.

Estimated delivery time: 1 to 14 business days.

The risk of damage or loss transfers to the consumer upon delivery.

Article 12 – Payment

Payments must be completed during checkout using the available payment methods.

Consumers must report incorrect payment details without delay.

Article 13 – Complaints Procedure

Complaints must be submitted by email within 7 days after discovery.

GARAX will respond within 14 days.

Article 14 – Governing Law

All agreements are governed exclusively by Dutch law, regardless of the consumer’s place of residence.

Article 15 – CESOP

Due to EU regulations effective from 2024 (CESOP), payment service providers may be required to report transaction data to European authorities.
